Thus the glitch...if we file like that then they will automatically go after the employer...and DH may still lose his job. No win.

Well DUH, I plan on doing the right thing...it just is gonna come back to bite us either way. Ah well...at least it is May and we have the rest of this year to make some money I suppose before the hammer comes down on the idiot who wants us to pretend like hubs doesn't work for him

The self-employment tax rate is a percentage set by law of your net earnings from self-employment. This rate consists of 12.4% for Social Security and 2.9% for Medicare.

But what about unemployment...tat is the stickler on this. Self employed folks aren't eligible...and I aint goin down without a fight on that one. That is the only thing that kept us from going under for the last few years as far as income. I am not about to give it up for some doofus who won't do the right thing. I don't mind stepping on some toes if they get in my way.

If you push the employer on it and lose the job for your efforts, you're still not getting anything. The result is the same if you pay the self-employment taxes and get laid off later anyways for whatever reason.

I think the taxes are based on *projected* earnings for the year. So if the job goes away partway through the year, you'll most like get a refund, I would think.

It's sounding like you've already made up you might to fight for the unemployment payments. Go git 'em, then.
